Protective Order Changes In Maryland

September 1, 2014

On October 1, 2014, several new laws took effect in Maryland. More specifically, the laws related to Protective Orders in the state have been updated.

The standard of evidence for obtaining a final protective order has been lowered from “clear and convincing evidence” to “a preponderance of evidence”. Maryland had been the only state in the nation that used the higher standard of proof for final protective orders.

Also, second-degree assault will be added to crimes under which a person can obtain a final protective order.

If you are in need of a protective order, or if a protective order has been filed against you, an attorney at Akman & Associates, PC can help you through this process. Our offices service individuals across both Maryland and Pennsylvania.
