Protective Order Changes In Maryland

On October 1, 2014, several new laws took effect in Maryland. More specifically, the laws related to Protective Orders in the state have been updated.

The standard of evidence for obtaining a final protective order has been lowered from “clear and convincing evidence” to “a preponderance of evidence”. Maryland had been the only state in the nation that used the higher standard of proof for final protective orders.

Also, second-degree assault will be added to crimes under which a person can obtain a final protective order.
